California Three Strikes Law

In 1994, California passed legislature that was given the title "Three Strikes and You're Out." This law can be found in Cal. Pen. Code § 667(e)(2), where it states that any person with two or more prior felony convictions who is convicted of a subsequent felony offense will face 25 years to life in prison. The statute has since been a cause of controversy as many people believe it violates the Eighth Amendment and is a form of "cruel and unusual punishment."

The Three Strikes Law also lengthens sentences for repeat felony offenders by adding years to their sentence for a second or subsequent offense. This can lead to absurd results in which a person convicted of two consecutive lesser felonies, such as drug possession, faces a longer prison term than someone convicted of a serious violent crime, such as rape or murder.
