Due to the dangerous nature of firearms and other weapons, there are very strict laws in California regarding their possession, sale, purchase, transportation, and use. These laws are meant to discourage violent crimes and aggravated offenses that often involve the display or use of firearms.   • Possession: Anyone convicted of a felony, convicted of violent use of a firearm (§ 23515), or who is addicted to any narcotic drug is prohibited from possessing a firearm (§ 29800).
  • Sale / Purchase: A person must be licensed according to § 26700 in order to sell, lease, or transfer firearms. Violation of this law is a misdemeanor, according to § 26500. A person must be over 21 years old to purchase a firearm per § 27505.
  • Transportation: As stated in in the section above, it is illegal to transfer firearms without a license. Even if you legally own a firearm, § 25850 states that carrying a loaded handgun in public is a misdemeanor, unless it involves the commission of a crime, which would make it a felony. Carrying an exposed, unloaded handgun in public also is a misdemeanor. In general, one should transport their firearms unloaded and in closed, identifiable cases. In vehicles, they should be placed in the trunk or back seat.
  • Use: Willfully discharging a firearm in a reckless or negligent manner is illegal under § 246.3 of the Penal Code. This violation could be sentenced as a misdemeanor and result in up to one year in jail or be classified as a felony and result in 16 months to 3 years in prison.
